Attorney Jason Stevens saved the defendant's driver's license when he argued that the defendant attempted to blow into a breathalyzer machine but the machine failed to quantify a result.  The Judge dismissed the summary suspension after finding that the defendant did not refuse to take a breath test.  Following the hearing the State's Attorney's Office voluntarily dismissed all charges.

The defendant was accused of driving under the influence of alcohol after a state trooper smelled alcohol on his breath while investigating an accident.  On cross examination the trooper admitted that he could not tell how much our client had to drink merely by the smell of alcohol.  In closing argument Attorney Jason Stevens noted that the state failed to elicit evidence of where his client was prior to being stopped and how much he had to drink.  The Judge found the defendant not-guilty of DUI after a bench trial.

Description: Dupage County Courthouse (Case # 14 OP 1498)

The respondent was served with a petition for a 2 year plenary order of protection by his ex-wife.  At the hearing attorney Jason Stevens established that the petitioner had multiple instances of voluntary contact with the respondent since she filed her petition.  Attorney Stevens argued that the petitioner's actions were not consistent with someone who was genuinely afraid and needed an order of protection.  The Judge agreed and ruled in favor of our client.

Description: Will County Courthouse (Case # 14 DT 561)

The defendant was pulled over for speeding and admitted to consuming 4 beers.  On cross-examination attorney Jason Stevens questioned the trooper with regards to his training and the trooper admitted that the human body absorbs approximately one alcoholic beverage per hour.  The trooper conceded that he did not know when the defendant consumed his last drink and did not know over how long a period of time he was drinking.  The Judge found the defendant not-guilty of DUI.

Description: Rolling Meadows Courthouse (Case # YB-058-340/41/42)

The defendant submitted to a standardized field sobriety test known as the Horizontal Gaze Nystagmus test ("HGN") and was charged with DUI.  At trial the arresting officer asserted that the defendant failed the test.  The Judge would not consider the officer's testimony when attorney Jason Stevens pointed out that the officer did not administer the test properly and did not testify that her training was in accordance with the standards set forth by the National Highway Traffic & Safety Administration ("NHTSA").  Attorney Stevens relied on People v. McKown 126 Ill. 2d 278; 924 N.E.2d 941; Ill. LEXIS 270; 338 Ill. Dec. 415 (2010) and the Judge would not consider the results of the HGN test.  The defendant was found not guilty of 2 counts of DUI.
